1. Agreement to Terms

By accessing or using Swolog ("Service"), operated by Swolog ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

Swolog is a web-based workout tracking application that helps users track their weightlifting training with volume accounting. The Service includes:

  • Workout logging and tracking
  • Volume calculation with primary and secondary muscle accounting
  • Mesocycle planning and management
  • Exercise library and custom exercise creation
  • Cloud synchronization across devices
  • Offline functionality via Progressive Web App technology

3. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials and not share them with others
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to use the Service. By using the Service, you represent that you are at least 13 years old.

4. Subscription and Payment

4.1 Free Trial

We offer a 14-day free trial for new users. No credit card is required to start your free trial. At the end of the trial period, you will need to subscribe to continue using the Service.

4.2 Subscription Fees

The Service is offered on a subscription basis at $4.99 per month. Subscription fees are billed in advance on a monthly basis and are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Payment Processing

Payments are processed through Stripe, a third-party payment processor. By providing payment information, you agree to Stripe's terms of service and privacy policy. We do not store your full credit card information on our servers.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refunds will be provided for partial months.

4.5 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle.

5. Promotional Codes

We may offer promotional codes that provide discounts, extended trials, or free access to the Service. Promotional codes:

  • Are valid only for the specific offer described
  • Cannot be combined with other offers unless explicitly stated
  • May expire or be discontinued at any time
  • Are limited to one use per account unless otherwise specified
  • Have no cash value and cannot be exchanged for cash

6. User Content and Data

6.1 Your Content

You retain ownership of all workout data, custom exercises, and other content you create or upload to the Service ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you.

6.2 Data Backup

While we implement reasonable measures to protect your data, we encourage you to maintain your own backups. We are not responsible for any loss of User Content.

6.3 Data Deletion

You may request deletion of your account and associated data by contacting us at hello@swolog.com. We will delete your data within 30 days of your request, except where we are required to retain it for legal or legitimate business purposes.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any laws
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the Service or servers connected to it
  • Use automated means to access the Service without our express permission
  • Reverse engineer or attempt to extract the source code
  • Share your account credentials with others
  • Use the Service to transmit malware or other harmful content

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Swolog and are protected by copyright, trademark, and other intellectual property laws.

"Swolog" and associated logos are trademarks of Swolog. You may not use these trademarks without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF THE SERVICE OR CONTENT
  • UNINTERRUPTED OR ERROR-FREE SERVICE

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWOLOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, DATA, OR GOODWILL
  • SERVICE INTERRUPTION OR COMPUTER DAMAGE
  • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Swolog and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • At your request

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Montana, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Montana.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Swolog regarding the Service and supersede any prior agreements.
